Many employers are still grappling with holiday pay processes and calculating holiday pay and the retained EU law for part year workers, variable hours and rolled-up holiday pay. New holiday pay legislation came into effect from 1 January 2024.
In this session Nicola Ihnatowicz will provide an update on what this legislation means when calculating statutory holiday entitlement for irregular hours workers and part-year workers (and current case law and new rules for the 12.07% calculation for irregular hours workers) and clarification on what additional payments need to be considered such as commission and overtime.

Nicola specialises in supporting businesses to become "Employers of the Future". Her expertise includes advising on sustainable workforces, achieving inclusivity and business transformation. She also supports employers with difficult employee relations matters, such as changing terms and conditions, managing stress at work, reasonable adjustments, discrimination and harassment investigations, and restructures and redundancies.
Nicola regularly advises and represents clients on Employment Tribunal matters and has recently dealt with complex claims for discrimination and harassment, holiday pay, whistleblowing and workplace stress. She is a frequent speaker at seminars and conferences, including the firm's weekly online Q&A "Trowers Tuesday".
Nicola chairs the firm's Social Impact Committee and has experience as a charity trustee.
